Terms of Service

1. Agreement to Terms

By accessing and using Prismojo (prismojo.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

We reserve the right to modify these terms at any time. Continued use of the service after modifications constitutes acceptance of the updated terms.

2. Eligibility & Registration

2.1 Age Requirement

You must be at least 18 years old to use Prismojo. By registering, you represent that you are 18 or older and have the legal authority to enter into this agreement.

2.2 Account Registration

To access certain features, you must create an account via email or OAuth (Google). You are responsible for maintaining the confidentiality of your login credentials and all activities under your account. You agree to provide accurate, current, and complete information during registration.

2.3 Prohibited Accounts

You may not:

• Create multiple accounts to circumvent purchase limits or exploit billing features
• Share your account credentials with others
• Impersonate another person or entity
• Use automated tools to create accounts or bypass access controls

3. Your Content & Rights

3.1 Ownership of Uploaded Photos

You retain full ownership of any photos you upload to Prismojo. By uploading, you grant us a limited, non-exclusive, worldwide license to process, store, and display your content solely to provide the service.

3.2 Photo Requirements

You represent and warrant that:

• You own or have obtained legal consent to use all uploaded photos
• Photos must not contain minors (persons under 18 years old)
• You have obtained consent from any identifiable adult in the photos
• Photos comply with applicable laws and do not infringe third-party rights

3.3 Generated Videos

Videos generated by Prismojo using your photos are created for your personal and commercial use. You own the generated video and may download, share, and reuse it without restrictions. Generated videos are AI-created and automatically labeled as such.

3.4 Explicit Content Policy

Prismojo employs automated content filtering to detect and reject sexual, violent, or exploitative content. We may refuse to generate videos that violate this policy. Content violations may result in account suspension.

4. Acceptable Use

4.1 Prohibited Content

You agree not to upload, generate, or distribute through Prismojo any content that:

• Contains nude, sexual, or exploitative material
• Depicts minors (persons under 18 years old)
• Depicts graphic violence, weapons, or gore
• Promotes hatred, discrimination, or disparagement of any person or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or other protected characteristics
• Infringes the copyright, trademark, or other intellectual property rights of others
• Constitutes a deepfake intended for deception, impersonation, or identity fraud
• Is used for harassment, defamation, or illegal purposes

4.2 Prohibited Conduct

You also agree not to:

• Bypass content filters through obfuscation or technical means
• Resell or distribute credits
• Use automated tools to scrape, test, or abuse the service
• Interfere with service infrastructure or security

5. Credits & Payments

5.1 Credits Are Non-Refundable

All credit purchases are final and non-refundable. This applies to all credit packages (Taster, Standard, Creator, Power). Credits never expire and remain in your account indefinitely.

5.2 EU Right of Withdrawal Waiver

Under EU law (Consumer Rights Directive 2011/83/EU), consumers have a 14-day right to withdraw from distance contracts. At checkout, you explicitly waive this right because credits are delivered immediately and cannot be returned.

5.3 Failed Generations

If a video generation fails, the reserved credits are automatically refunded to your account within 24 hours. You will not be charged for failed attempts.

5.4 Unauthorized Charges

If you believe you were charged in error, contact us at Contact. We will investigate disputes within 48 hours. Chargebacks or payment reversals may result in account suspension.

5.5 Credit Packages

We offer four credit packages:

• Taster: 60 credits ($5.99 for new users, $9.99 for returning users)
• Standard: 200 credits ($14.99)
• Creator: 500 credits ($29.99)
• Power: 1,200 credits ($59.99)

Taster Pack can be purchased unlimited times. Prices are subject to change with notice. Payments are processed by Waffo Pancake.

5.6 Fraud Prevention

Prismojo uses fraud detection to prevent unauthorized purchases, card testing, and affiliate abuse. Suspected fraud may result in order cancellation and account suspension.

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• Prismojo is provided "as is" without warranties of any kind
• We disclaim liability for service interruptions, data loss, or generation failures
• We are not liable for third-party content or actions by other users
• Our total liability shall not exceed the amount you paid in the last 12 months

7. Termination

We may suspend or terminate your account if you violate these terms, engage in fraud, or use the service for illegal purposes. Termination is effective immediately and you forfeit unused credits.

8. Governing Law

These terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
